Addressing A Prospective Employer’s Request for Job Candidate’s Facebook Log-In Info?

A recent syndicated article has circulated, addressing the practice of employers requiring prospective hires to provide their Facebook username and password, during the initial interview process. The article is titled “Can employers legally ask you for your Facebook password when applying for a job?” Why Congress and the States should ban this practice.” As the title indicates, this article is about what legal steps have been and can be taken to address this questionable employment hiring practice. However, that article is missing the plus side practical and demanding of the problem, which is the dilemma facing the job seeker, when asked for this private information.

From the point of view of both an employer and an employment lawyer, I will try to address this issue briefly. The question is, until effective laws are put in place to prevent the practice of an employer soliciting a respondent’s Facebook login information, what can you do to protect your Facebook privacy when searching for a job? new job?

Yes and No. Let me explain….

Privacy settings

First keep it clean! Always keep in mind that Facebook is constantly (seemingly) changing its interface and privacy settings – stay abreast of these changes and select your personal security and privacy settings wisely. Of course they wouldn’t – but logging into your Facebook account grants you this same kind of information – access to any personal email you’ve sent through Facebook’s email interface, a complete view of all the posts and comments you have you ever done, a quick view of ALL your Facebook activity, for as long as you have had your Facebook account and access to your security settings, friend lists, blocked friends, etc. This is an invasion of your reasonable expectation of privacy.

How do I respond to a request from a prospective employer for My Facebook login information?

If you read the previous paragraph, I think a very pragmatic approach to addressing such a request would be to explain in response to that inquiry, outlining the concerns outlined above. Couple these privacy concerns with offering a less intrusive method for the prospective employer to get the information they seek. What is the employer looking for? In part, it may simply be to gauge how you respond to that request. Therefore, be prepared to respond with confidence by addressing your privacy concerns and offering a different approach and referring the question to the employer. Ask the interviewer or prospective employer what they are looking for and, if reasonable, in your mind, offer to “friend” them to give them an idea of ​​the information available. Alternatively, you could offer to simply answer their questions on a certain topic, thus relieving them of the burden of explaining what precise information they are looking for. These approaches show problem solving and critical thinking skills on your part, which are likely good qualities for any job you are looking for. They show that you are cooperative and work constructively to resolve potential conflicts by standing up for your beliefs.

Should I create a second Facebook profile?

Without going into the technical details (which I’m not qualified to fully explain anyway), when you delete electronically stored information, you’re simply eliminating ROM access and indexing to that information – the actual information remains on the drive, albeit partitioned by somewhere and not indexed. Over time it may be partially or entirely overwritten, but this may not happen for a considerable amount of time, if at all. Also, by transmitting information through your company device, that information will likely pass through and be processed by your company’s server, leaving traces and the actual underlying information there for your employer to see. Also, auto-stored passwords and the like, when enabled, can give your employer easy access to ALL of your account information. This topic deserves much more, but that is not the purpose of this article.
